I object to this application in its current form for the following reasons
1. The additional size and scope of activities including extension of trading hours will result in increased noise emanating from site
2. No details provided of additional equipment being installed such as high pressure cleaning and or heavy machinery
3. No specific details included regarding extension of trading hours
4. No consultation with local residents regarding how this extension will impact on our right to quiet enjoyment of our home
5. No details of lease period. In the past we were told that the initial lease did not have an extension clause beyond the 10 year period.

My objections are
a) extended hours of operations resulting in significant increase in noise
b) the doubling of boat storage area will also increase noise and pollution
c) additional car spaces from 45 to 81 which also means additional noise and pollution.

These issues will affect homes in the immediate vicinity of this business.

Dear Mr Nixey,

We are writing to express our concern regarding the Modification Request of the Refuelling and Supply Facility at White Bay. We are local residents residing at 11/1-13 Grafton Street Balmain. Our building is directly adjacent to the site and houses over 58 residents.

Local residents were led to believe that the first lease granted for this facility was to be for a limited period of time. At that time we were assured that the lease would then be reassessed, focussing on the suitability of the facility remaining so close to a built-up residential area. Since there is a request for approval to expand, we assume they are confident of their lease being extended.

We request advice on whether this is the case and if there has been any consultation with local residents or Council about this matter?

We have serious reservations about the negative impact the modifications of the facility will have on the neighbourhood. In particular,

* An additional boat storage facility for up to 126 boats assures additional machinery noise, adversely impacting on local residents. We have, in the past, been disturbed by prolonged banging and machinery noise, especially on weekends. Bell's management has ignored our concerns, conveyed by telephone. In addition fuel tanker deliveries occur at all hours, night or day, often before 6AM.

* Extending the hours of operation during summer daylight saving and peak periods will inevitably result in even more machinery noise and disturbance for a longer period of time. Operational hours should be limited as much as possible due to the proximity of so many residents - there is already a constant level of machinery noise, often occurring at weekends and after hours.

We are opposed to the proposed modification application as this location is clearly unsuitable for industrial activity, being so close to a densely populated residential area and we request that serious consideration is given to refusing the application.

Dear Mr Nixey,

We are writing to express our concerns regarding the planning application of the Modification Request of the Refuelling and Supply Facility at White Bay. We are local residents of the area with an apartment very close to the site at 22/1-13 Grafton Street, Balmain.

From past history with this facility, our understanding is that we were led to believe that the lease when first granted for this business was only going to be for a limited period of time. The residents were assured that the lease would then be reassessed for suitability of this type of facility remaining in an area so closely surrounded by residential properties.

It is our assumption that if the facility is requesting approval to expand, they are also assuming they will have their lease extended?
Firstly, are you kindly able to advise whether this is the case and whether there has been any consultation with the local residents about this?

Secondly, we do have great concerns about the negative impact some of these new modifications will have on the neighbourhood. In summary:
* With the current boat storage numbers there is considerable noise throughout the days and evenings. With the new additional boat storage facilities for up to 126 boats, this will guarantee more machinery noise and a further negative impact on the local residents.
* We express concern over fuel vapours and the challenges of the further strength and extent of these odours given the greater extent of refuelling more boats throughout longer periods, which could be damaging to the health of close local residents.
* Extending the hours of operation during summer daylight saving and 'peak periods' indicates even more machinery noise and disturbance to the local residents for a longer time period. The definition of 'Peak periods' is too open a time frame in this situation. Any time day or night could be justified as a peak period. If approved, operational hours need to be limited as much as possible due to the proximity of so many residences as there is already an almost constant level of machinery noise and general disturbance of the peace.

As you can hopefully understand, we are against the proposed modification application given this particular site is located far too close to a densely populated residential area and request that you give all consideration to refuse the application.

We are concerned that the proposal to increase the size of the marina to the extent proposed will cause an unacceptable increase in traffic and parking requirements in an area which has but one limited street leading to the water. A proposed doubling of the present parking bays would more than double traffic leading to congestion and potential damage to vehicles particularly in peak times, i e morning and afternoon/evening periods.
Traffic build up and noise would seriously affect the amenities of the precinct that is primarily residential.
The area would be affected, not only during the construction works proposed to increase the building sizes and ancillary finger wharf, but the planned doubling of boat-storage area would result in a sizeable and continual addition to visitor numbers, again in an area which is obviously restricted in its ability to cope with what would become a noisy and almost factory-like situation. In particular, there must be an early-evening curfew time-limitation imposed so that night noise is shut down.

We are the owners and residents of an apartment in the residential building
1-13 Grafton Street, Balmain NSW 2041.

On inspection of the Modification Request for the proposed Marine Refuelling and Supply Facility, Lot 1 and Lot 3, Berth 6 White Bay, Balmain (Application No. MP 06_0037 MOD 5) we would like to register our serious concerns about this proposal.

We believe the potential impact of the proposed development will not only affect all residents in our building and along Grafton Street but will extend far beyond the immediate locality to all of Balmain - and specifically to a wide area of surrounding streets including Ewenton Street, Jubilee Place , Datchett Street and as far as Hosking and William Streets.

The current character of the neighbourhood around Grafton Street is in keeping with the eastern end of Balmain and is (mainly) a quiet, tranquil, residential peninsula with a small park (Ewenton Park) that is enjoyed by all Balmain-dwellers.

The existing business located at this site already generates a significant amount of noise at a high level with current permitted marine refuelling operations and boat storage operations. The busiest times are at weekends and public holidays which affect many Balmain residents who are trying to enjoy the green space offered by Ewenton Park. Although 1-13 Grafton Street residents accept a certain level of noise - especially as the Water Police are also located in this area - the current business operation is already known to sometimes work outside of the agreed operation times which is a cause of great disturbance to locals. Any increase in operations - both in volume of activity and in extension of working hours - will undoubtedly increase this disturbance and noise pollution.

Extension of the current buildings on such a small area of land will ensure a loss of privacy for the residents of 1-13 Grafton Street as the apartment building will inevitably be overlooked. Over-development of this small space will also change the character of this pocket of Balmain which has already accepted significant change with the development of James Craig Road. It would actually be preferable to return this area to parkland to be enjoyed by locals rather than industrialise the foreshore even further.

The additional traffic generated by the proposed increase in the boat storage facility and tankers carrying vast quantities of flammable fuel, will cause even more issues for Balmain which is already very congested with only two roads in and out of the peninsula.

We would like to state that we are not averse to the current business - we do however object to any extension in terms of building size and footprint, noise, operating hours, volume of traffic - all which would have significant impact on our neighbourhood.

Dear Mr Nixey

I am writing to object to the above proposal and express my concern regarding the Modification Request of the Refuelling and Supply Facility at White Bay.

I reside at 9/1-13 Grafton Street Balmain which is next to the site. There are 28 apartments and approximately 60 residents.

I bought the apartment and moved in May 2016. I was led to believe the first lease for the facility was for a limited period of time. As there are plans for expansion I assume the lease is being extended.

Is this correct and has there been consultation with local residents or Council? I have not been consulted.

The current facility is noisy and does not adhere to the proposed opening hours. There are often very early fuel deliveries (some at 4am) as well as late activity. I made a complaint at 9 pm on 27 September to Jeremy at Sydney Harbour Boat Storage. He investigated and admitted someone was using an electric saw at 9 pm on a Wednesday night.

I have serious concerns about the impact modifications of the facility will have on me and other residents within the neighbourhood. Specifically:

* Expanded boat storage facility for126 boats means additional machinery noise which is already impacting on local residents. Apart from my specific complaint above there is often excess noise including machines being operated late at night, early in the morning and on weekends.

* Fuel deliveries are meant to be during business hours but take place at any time, sometimes between 10 pm and 6am. This would increase with a larger facility.

* Extending the hours of operation during summer daylight saving and peak periods will lead to more disturbance for a longer period of time. Operational hours should be limited, monitored and reported when breached.

I am vehemently opposed to the application. The site is within five metres of a residential dwelling which is densely populated.

White Bay 6 Marine Park provides economic stimulus to the local region through employment and is a major stakeholder and supplier in waterbased community transport. The success of this recent modification professionalises the facility and provides a stronger base for services that support "Working Harbour" for Sydney. The regulation of this site, as well as the construction of an amended and previously approved development proposal, will assist in reducing site noise, allow further economic support to the region and create facilities that a rare and well needed within the harbour. I believe that the modification does not direct the business away from its initial conditions of approval but allows the business to provide supporting services to the working harbour.

Firstly the local residents were led to believe that the lease which was first granted for this facility was only going to be for a limited period of time. We were assured that the lease would then be reassessed about the suitability of the facility remaining in an area so close to a residential area. I presume that if the facility is requesting approval to expand, they are assuming they will have their lease extended. Could you advise whether this is the case and whether there has been any consultation with the local residents about this? Is there no other area within the western harbour which the Facility could me moved to which would have less impact on residents?

I am not in favour of the proposed modification application as this particular site is located too close to a densely populated area and I ask that you give serious consideration to refusing the application.
