We believe all of the following need to be addressed before proper
consideration can be made of this proposed modification. 1. Please
confirm that the outdoor use of the café will cease no later than 10pm
every day 2. Please confirm that the indoor use of the café will cease
no later than 11pm on Thursday, Friday and Saturday and 10:30pm on all
other days of the week 3. Please confirm that no live entertainment
will be carried out on the site 4. Please advise what approvals were
granted and what community liaison was undertaken prior to the
performance of live entertainment on site on January 27 and 28, 2018
5. Please advise if the Trial Period (as defined in the Project
Approval) has been undertaken or will be undertaken as part of this
proposed modification 6. Please provide a copy of the Operational
Environmental Management Plan and in particular the Noise Management
Plan and evidence that the approval conditions were satisfied for this
plan 7. Please provide the date when an appropriate Noise Management
Plan was/will be implemented for café/restaurant style operations to
ensure that the noise limits are not exceeded at the most affected
point and confirm that the commencement will be prior to commencing
operations 8. Please provide the evidence that the temporary building,
which was originally approved only for office use and is now proposed
to be used for office and café use, has suitable construction to
prevent noise transmission from café operations and in particular
satisfies the approval conditions with regards to the construction of
any restaurant/café on site. 9. Please advise the current structure
and membership of the Community Liaison Committee including how long
each member has been on the committee, any relationship each committee
member has to any party with an interest in or connection to the
development and/or operations of the site as well as the process for
replacing committee members.

Objections to MOD 8 for Sydney Boathouse 1. ** Foreshore Walk ** A
long-standing promise has been made by Government to provide a
foreshore walk around this region of the harbour. Most recently this
has been an important component of the Bays Precinct planning. The
proposed modification seeks further approval for temporary at-grade
car parking, for temporary boat storage on the hardstand, and for use
a temporary building (as office & cafe). Natural questions follow:
Will these approvals continue to allow a suitable corridor for the
foreshore walk? Will the foreshore walk be constrained by the proposed
modification? If there is not already a constraint dealing with
provision of a suitable foreshore walk corridor, there should be one
imposed as part of any approval of MOD 8. 2. ** Unsightly temporary
usage ** The temporary building, the temporary at-grade car parking,
and the parking of boats on the hardstand will all contribute to an
unsightly look for the Sydney Boathouse. There is a neater solution to
most of these issues. The Sydney Superyacht Marina, right next door,
has office space to rent and an apparently underused car park. The
Sydney Boathouse has the Western Boat Store building in operation. The
existence of these facilities leads to the obvious questions: Why have
a temporary building when there is unused space to rent right next
door? Why have temporary car parking when there is an underutilized
multi-storey car park right next door? Why have boats on hardstand,
when there is a building (the Western Boat Store) that presumably
could take many of them.

Dear Mr Green, MOD8, Dry Boat Store and Marine Facility, Rozelle We wish
to object to elements of the above MOD8. * Retain a temporary building
located in the SW extent of the site for a further 6 years * Add a
deck to the temporary building to use as a café and office building
The basis of our objection is the increasing use of MODs by private
and government instrumentalities to enshrine the principle of
"creeping" extensions for facilities which are clearly depicted as
"temporary" in the original DA and then which become virtually
"permanent". This proposal falls within the Bays Precinct which is
supposedly undergoing "transformation" (presumably for the better).
This matter has not been raised with members of the Bays Precinct CRG
and it will obviously affect planning for the future of this section
of the Bays Precinct and its ultimate implementation. Once again, we
are faced with ad hoc, one-off proposals without any thought given to
the cumulative impact on Bays Precinct planning. We are also cognizant
of the increasing pressures on the scarce Bays foreshore space,
including a proposal (MOD3) to relocate "temporarily" for 10 years
Blackwattle Bay Marina party boat facility to the residential area of
Bank Street, Pyrmont. If MOD8 is approved, that sets a precedent for
further extensions of time for this appalling facility (MOD3) when the
10 years are up. The investment of funds in a deck to house café and
office building indicates that this supposed "temporary" development
is, in reality, a "permanent" facility and, as such, we oppose any
further such modifications within the Bays Precinct. Any proposals for
development should be considered only when the Master Planning for the
Bays Precinct has been completed and endorsed both by the community
