From 14 August until 13 September 2023, the department exhibited an explanation of intended effect (EIE) outlining a proposed amendment to Chapter 13 of State Environmental Planning Policy (Biodiversity and Conservation) 2021 (B&C SEPP) to support the implementation of the Cumberland Plain Conservation Plan (CPCP).
The proposed change:
- sought to amend maps associated with Chapter 13 of the B&C SEPP to remove 22 lots and one small area that is a part of a transport easement from the strategic conservation area (SCA).
- only apply to the identified lots and small area in the SCA (around 175 hectares of SCA across the CPCP area).
While implementing the CPCP, the department identified that those lands have already been zoned for urban development prior to the release of the plan, including land currently in R2 Low Density Residential, R5 Large Lot Residential and E5 Heavy Industrial. The existing zones do not align with the SCA’s objectives and it is proposed to remove these lots from the SCA.
This proposed amendment will not affect the CPCP’s commitments and actions to protect, enhance, maintain and restore biodiversity in Western Sydney or the offsetting impacts for biodiversity.
The discussion paper was on exhibition for public comment from 14 August until 13 September 2023. Thank you to everyone who provided feedback. The department is now considering comments received in the finalisation of the proposed amendments.
