Rezoning of Area 14-1A Lake Cathie Urban Release Area for residential and environmental protection purposes (Amendment No 5)

The planning proposal seeks to rezone land at Ocean Drive and Forest Parkway Lake Cathie from 1(a1) Rural and 2(a4) Low Density Residential under the Hastings LEP 2001 to zones consistent with the Standard LEP format being R1 General Residential, E2 Environmental Conservation and E3 Environmental Management, to allow the development of 221 residential lots and protection of the land's natural values.The Hastings Urban Growth Strategy(HUGS)identified investigation areas in the Lake Cathie and Bonny Hills area as Area 14. Council resolved in 2004 to proceed with a draft plan for Area 14(Draft Amendment No 53). An environmental study was prepared and Council certified the plan for exhibition in 2005. Council subsequently resolved to proceed with a draft plan for Stage 1A of the Area 14 urban release area and revised and updated the environmental study for the land. The draft plan ceased to be a "pending LEP" under the transtional arrangments of clause 12(1)of the Regulation on 1 July 2010 and the RPA has submitted a planning proposal requesting consideration that all actions up to s57 be waived in view of the advanced stage of the the proposal under the repealed provisions.
