Amendment to Camden LEP 2010 - 23 Harrington Street, Elderslie

To permit additional uses on land zoned RE2 Private Recreation as follows:Entertainment facilities;Funeral chapels;Funeral homes;Hotel or motel accommodation;Information and educational facilities;Office premises;Serviced apartments;Place of public worship;Restaurants;Tourist and visitor centres; andVeterinary hospital. The site The subject land (location map at attachment A) is approximately 1.2 km from the Camden Town Centre along Camden Valley Way. It is within the established area of Elderslie and within proximity to the Elderslie Urban Release Area. The site is surrounded by RE1 Public Recreation zoned lands on the north and south-eastern side (Harrington Green and Hilder Public Reserves). On the western side are R2 Low Density Residential zoned areas, including Camden Christadelphian Ecclesia Church and immediately to the north-eastern side is a caravan/camper sales business. Across the Camden Valley Way on the north-western side is Nepean Floodplain, which is zoned RU1 Primary Production. BackgroundThe land was previously zoned 6(c) Private Open Space under Camden LEP 46. Three DA consents have been given for development on the site; * a convention centre, comprising: function rooms, a 45 room motel, a tennis court and a swimming pool (1996; * a convention centre, restaurant and 25 serviced apartments (June 2002), and * modification to the 2002 DA in August 2006. It is understood that while construction was not carried out, the 2006 consent remains valid. However, Council was advised by the developers that the proposed development at this location was not viable.The owners lodged a submission to Council for rezoning to a business zone during the public exhibition of the Principal LEP in 2009. However, Council made a decision that it was beyond the scope of the PLEP for rezoning. Council acknowledged that the existing Private Recreation zoning for the site was not considered to be entirely appropriate and that the site's location and attributes/constraints necessitated a site specific LEP amendment approach. In particular, Council took into consideration the site's:* prominence within the Camden Valley Way visual catchment at the northern entry point into the town centre, * proximity to the town centre and * flood affectation.As result, additional uses within Schedule 1 of the LEP were included.
