Penalty Notices and Official Caution issued to Sibelco Australia Limited (MP 09_0091, Port Stephens Council LGA)

On 16 April 2020, the Department issued three Penalty Notices (3 x $15,000) and an Official Caution to Sibelco Australia Limited (Sibelco) for failing to implement the approved Biodiversity Management Plan (BMP) and the Environmental Management Strategy (EMS) at the Tanilba Northern Dune Extension Project. The Department’s investigation found that Sibelco failed to undertake monitoring for several threatened species (including the Koala, Wallum Froglet, and the Novel Uperoleia species), failed to expand and enhance koala habitat, and failed to undertake weed and pest management at the site.  Sibelco has since committed to undertake the biodiversity monitoring and management actions as required by the BMP and EMS.

Official Caution issued to Sibelco Australia Limited (MP 09_0091, Port Stephens Council LGA)

On 16 April 2020, the Department issued an Official Caution to Sibelco Australia Limited (Sibelco) for failing to implement the approved Groundwater Monitoring Program by reducing monitoring frequency at the Tanilba Northern Dune Extension Project in the 2018 and 2019, prior to the changed regime being approved by the Department.  Sibelco has since updated the Groundwater Management Plan, which has been approved by the Department.

Official Caution issued to Sibelco Australia Limited (MP 09_0091, Port Stephens Council LGA)

On 16 April 2020, the Department issued an Official Caution to Sibelco Australia Limited (Sibelco) for failing to notify the Department of non-compliances with the Biodiversity Management Plan, Environmental Management Strategy and Groundwater Management Plan at the Tanilba Northern Dune Extension Project. The conditions of the project approval require Sibelco to notify the Department of any incident (which includes breaches of project approval conditions) as soon as practicable.

After reading the EA, 90 0091, I could not find anywhere that companies driving large, heavy trucks on the small roads of Salt Ash, make any contribution to the up keep of the roads they use.

Also no environmental study was carried out on the noise level these trucks make in the process of cartage of the sand.

My property backs onto Lemon Tree Passage Road. I have recorded noise levels of traffic including the large trucks, way above the 55dB acceptable in residential areas.

The current 70 & 90 kilometer speed limit should be reduced to 50 kilometer for suburban living. This would reduce the noise levels.

Truck braking is also a problem with many operators using their engine to slow the truck rather then normal brakes. This is a terrible rumbling noise that travel through the area.

I object to the large trucks being used in a residential area at high speed and not contributing to the upkeep of the roads.

I object to the EA as it has not address the noise environment due to traffic, in the area.
