Based on the information provided, the Over Station Development (OSD) does not constitute a Scheduled Activity under Schedule 1 of the Protection of the Environment Operations Act 1997 (POEO Act). At this stage, the EPA does not consider that the proposal will require an Environment Protection Licence (EPL) under the POEO Act. The EPA understands that the proposal is not being undertake on behalf of a NSW public authority. The EPA is therefore not the appropriate regulatory authority for the environmental performance of the project.

Accordingly, the EPA has no comments regarding the proposal.

As an advisory note only, the future OSD will be located in close proximity to the operational rail network, for which EPA has a regulatory responsibility. Any future planning approvals permitting further development of the site should include acceptable vibration and ground-borne noise limits for spaces within the development drawn from the EPA’s Rail Infrastructure Noise Guideline (EPA, 2013) and Assessing Vibration: a technical guideline (DEC, 2006).

I will now have construction noise for the next three years irritating me.

The ESD report in the application is very poor and fails to endeavour to achieve the world class targets that a project of this magnitude should aim for. The targets described in the report are largely tied to Greenstar and or NaBers performance indicators. Both standards are commonly used through the local
Industry particularly manera is becoming outdated but more significantly fail to address significant opportunities for a wholistic approach to ESD. Reading through the report some of the targets are far too low and uncompromising, for instance the requirement for sustainable use of water is limited to using wells rated fittings and fixture, same as you would find BASIX requires for a typical granny flat, no mention of mining black or grey water which in a project of this scale would deliver significant results and provide a case study for future significant projects. Energy management both through construction and operation is offset to a non denominational construction management plan and “good design” one would expect lofty targets for the use of sustainable energy would be introduced in the project, instead no tangible and reportable targets are set. Similarly stewardship and protection of biodiversity is addresses n a single paragraph stating that at level 10 there will be a rooftop garden, the project is I. The vicinity of Hyde Park and Sydney harbour, it is a high rise building, there are significant issues with the impact to biodiversity in both Hyde Park and Sydney harbour as a result of urban development, to name a few, alteration of wind patterns which may affect fly paths of local
Indigenous species of bird’s and bats, increased use of artificial
Light at nightime affecting the biological
Patterns of local birds and mammals.
The report is poor, appears to limit to ticking boxes to appear to address issues, but completely fails to embrace and harness the opportunity to set a ESD approach that is responsible and caring for the future generations.

The proposed podium height adjacent to The National Building will significantly reduce natural light to office suites within The National Building. This will result in a reduction in value of these office suites, and make them less attractive to lease or sell. Currently the boundary wall between 250 Pitt St and 254 Pitt St only comes to level 2 within 250 Pitt St, which allows light to reach the suites on level 1 and 2. The proposal to increase the podium height to the top of the National Building will block all of this light. The addition of office towers on top of the podium will further decrease this natural light.
Additionally a sculptural artwork commissioned by the Owners Corporation of 250 Pitt St and positioned within the light well of 250 Pitt St will no longer be visible to occupants within the National Building.

Thank you for your emails of 16 July 2020 requesting comment from the Civil Aviation Safety Authority (CASA) on the Pitt Street North Over Station Development Modification (SSD-8875-Mod-1) and the Pitt Street North Over Station Development Stage 2 (SSD-10375).

CASA has reviewed the Aeronautical Impact Statement (AIS) for the Pitt Street North Over Station Development Stage 2 and has no issues with the assessment and no objections to the proposed building development. CASA assessed the building at a height of 188.6m above Australian Height Datum (AHD) under the Airspace Regulations 2007 on 6 February 2018. A copy of this assessment is attached for your information.

The Aeronautical Impact Assessment covers the tower cranes up to a height of 241m above AHD that will construct the building. In principal CASA has no objections to the tower cranes, however detailed recommendations for the tower will be made on receipt of an Invitation to Comment from Sydney Airport.

CASA has no specific comments on the Pitt Street North Over Station Modification Report.

A variation approval was issued on 20/9/2018 for this development to a height of 189m AHD, as it does not seem this height has increased, the original decision still stands.

FRNSW has received your request for comment on the EIS for the Pitt Street North Over Station Development Stage 2 (SSD-10375).

No review or comment will be provided at this time due to extensive consultation being undertaken on the project. Monthly meetings are being held, for review of the FEB & FER ,in regard to the development of the Metro Station and OSD between FRNSW, Fire Engineers, Contractors and TfNSW.
