DA 305-7-2003 MOD 10 or Mod 11 depending on which is correct-your site or Wambo's application

The timeframe for submission to this expansion lacks any form of consideration towards any other interests bar the mining company.
The documents were not available for view at Singleton Council until some-time after the 17th July 2012. This is no realistic time to read the documentation fully to prepare a submission.
Wambo Coal has a history of providing misleading information to authorities or no information as required. You would have no information related to the failure of the current South Dam to contain waters in March this year and the failure of Wambo to advise of this.
As a member of the Wambo CCC I would have been advised of this application prior to the lodgement and given some foresight but this was not so.
I wish to lodge my objection to the modification listed above for the following reasons:

1 The application is made under Section 75W modification, involving use of Part 3A processes to modify the Part 4 consent. Part 3A was to be replaced after the recent elections with the gateways process as replacement. This appears to be overlooked in the mine interest. The Minister for planning assured us that aquifers were to be properly protected. This is not happening. This application is founded on a preposterous interpretation of the acts.

2 Consultation as claimed did not happen. The CCC was not given an overview in May 2012.

3 Reference to Approval DA 305-7-2003 MOD 8 South Wambo needs to be made, given the objections made by myself with the recent incidents to note:
a The dam still is under potential subsidence as well as to be subsided again.
b In March this year the dam was unable to contain water and overtopped. This was not reported in a timely manner, appropriately or to the requirements now in place.
c The dam still has ability to threaten travel over our Right of Way. Water may be redirected around the dam through to North Wambo Creek.
d The dam may breach or leak.
e There is still the ongoing impacts of dewatering pumping from the dewatering bores, that are now installed without applications to install or even consultation. This has and will have a further impact on our aquifers and the flow potential of South Wambo Creek.
f The size of the dam and the containment of water within does not include catchment, for consideration during states of fill with the influence of rainfall.
4 Noise intrusion from the construction site will impact on our residence despite the fact the consultants failed to make this potential to consider.

5 Appendix 3, page 87 is misinformation provided by Wambo Coal, relative to the Aboriginal sites known as the Bora Grounds, to avoid proper review of the area. Within information referenced there appears to be no references to pre 2003 assessments for Wambo Coal, nor from local information sources regarding the aboriginal sites.

6 Within Environmental Assessment, Appendix D, Agricultural resources assessment, the referencing to the Draft Upper Hunter Strategic Regional Land Use Plan (DSRLUP) (NSW Government, 2012) makes use of further information that is not accurate.
This information is based on incomplete mapping that has been provided only by select stakeholders for the revue, including mines. Incidentally the land has been mine controlled for decades and has no agricultural usage.
The reference to Rural Land Classification of IV lacks credibility as no one has properly assessed this. The reference to the stocking rate of 3 DSE/ha, with a Gross Margin of $53.06/ha/year is meaningless.
I will request further time to fully read the document to finalise my submission, with the intent that it will be forwarded after I receive your extension of this time.
