is negated as a separate consent under the LLS Act.
Review of the numerous documents currently available on the Department’s website notes that the
following points previously proposed by LLS have been incorporated to assist inform the EIS:
- Cleared farmland will be considered Category 1 land.
- remnant areas and scattered trees have been deemed Category 2 land and, the removal of, will
generate credits.
- remove or minimise impacts to the ecological values within the project area. The EIS addresses
impact on remnant native vegetation and the scattered paddock trees, and to be avoided as far as
practicable.
- Vulnerable land (shown on attached map) NOT to have development impact.
- buffers to be created to ensure indirect impacts do not occur during construction or operation of
the Solar Farm
- Tree Protection Zones to be established on remnant vegetation and scattered trees not approved
for clearing, with retained patches of vegetation to be fenced, and operations excluded from them.
- a BDAR has been prepared, and OEH input sought via consultation
Additionally, prior to planning approval being finalised, there has been provided a detailed
description of the proposed regime for avoiding, minimising, managing and reporting on the
biodiversity impacts of the development. The strategy to offset any residual impacts of the
development in accordance with the Biodiversity Conservation Act 2016 is in place.
LLS has no further input from a native vegetation management and planning perspective for
SSD9549.
