Dear Mr Lusher,

Thank you for your letter notifying Sydney Water of the proposed development referenced above.

Due to the scale and type of development the proponent will be required to gain a Section 73 Certificate, according to the Sydney Water Act 1994. We request that Council include the following condition in the development consent to be met before you issue the Occupation Certificate.

Requirements for Section 73 Certificate
A Section 73 Compliance Certificate under the Sydney Water Act 1994 must be obtained from Sydney Water.

Make an early application for the certificate, as there may be water and sewer pipes to be built and this can take some time. This can also impact on other services and building, driveway or landscape design.

Application must be made through an authorised Water Servicing Coordinator. For help either visit www.sydneywater.com.au > Plumbing, building and developing > Developing > Land development or telephone 13 20 92.

We also request that Council includes the following condition in the development consent to be met before they issue the Construction Certificate.

Building Plan Approval
The approved plans must be submitted to a Sydney Water Quick Check agent to determine whether the development will affect any Sydney Water sewer or water main, stormwater drains and/or easement, and if further requirements need to be met. Plans will be appropriately stamped.

As a owner of an apartment directly facing the northern tower(Windsor on Kent) i am extremely concerned of this development proposal

The 2 additional floors will significantly impact the views for each floor from level 13 to level 19, will bring down the value of the darling harbour facing units due to the reduced view and reduced natural light , will produce significant noise due to the new Bar being on the rooftop, will bring considerable disturbance due to the construction work

We are already suffering the constant noise(even at nightime and early morning outside the agreed working hours) due to the cranes operating on Four Points

The project is based on the need to exploit the "exceptional views" of Darling Harbour from the northern tower, without considering that they will be stealing those views from the owners of the residential buildings around Four Points

This proposal will completely obliterate the Darling Harbour views of the apartments of Windsor on Kent building facing Darling Harbour

The value of our apartments is strictly linked to the views, thus would be considerably reduced

We don't want to put up with the noise of the rooftop bar, the disturbance of the construction works
We hare already suffering continuing disturbance of Sheraton's crane operating constantly...it's enough!!!

Sheraton is building a new 25 storey tower, they can use the new tower for a rooftop bar instead of affecting additional residential buildings

The proposed additional floors of Four Point will cause a significant impact on the buildings around it. Blocking not only the natural light but also the view that people have forked out hundred of thousands for. It is unfair for people who bought their apartments for the view for it to be stolen by the proposed plan. It is unfair that Four Point wants to increase their revenue and making its neighbours sacrifice the value of their place and losing out on the sunlight and view. It's an inconsiderate plan. They should consider renovating the internal of their 2 existing floors if they really want to have an Executive Lounge and Bar instead of impacting other people over their proposal.

Apart from this, the construction of the additional floors will not only causing air pollution to the people living around there but also causing a great amount of noises. The bar itself will cause an ongoing noise disturbance to the residents around the area. Unfortunately I do not see the benefits of the proposal and am opposing to the development plan.

As the owner of the above property I am strongly against the application of Four Points Sheraton Hotel to build a two story "Executive Lounge and Bar" on the top of existing northern tower. As I understand the plans, the extension will block or reduce the view of Darling Harbour and diminish the nature light falling on our property which will significantly reduce the light and openness of the property and decrease the value of the apartment.
Along with the other owners I trust that the council will take serious consideration of our strong concerns and block the project from preceding.

My location on Windsor on Kent is southwest apartment, level 18 - W07.

The main reason I purchased this apartment is to sit on my balcony and enjoy water views, including the views of the Maritime Museum, Star City, fireworks, Anzac Bridge etc. I chose to take out a larger mortgage with the benefit of these views.

As mentioned in the Environmental Impact Assessment my view is considered of medium-high significance. The 2 additional floors of the rooftop bar are causing this stress.

As a result, not only is there financial stress but there is lifestyle stress, increased noise from the bar and the reduction of natural light.

We have hundreds of bars in the city of Sydney. The cost-benefit of having yet another bar while "robbing residents of their lifestyle" is ludicrous. We are forgetting that this city is a growing residential city and so much money, effort and parallel projects are being invested to building this city to cater for the residential lifestyle. Yet these extra 2 floors to build a bar contradicts these projects.

Let's keep focussed on bigger issues such as sustainability.

We are the owners of unit 162/365 Kent St, Sydney. The unit is on level 21 facing Darling Harbour. It is currently rented but we intend to move in when we retire in a few years time.

we have been in search of a retirement home for many years and were very happy to have found this property, for its location and for its excellent view of the harbour.

The proposed development of Four Points Sheraton is concerning. The additional floors will not only significantly impact the views from our unit but the noise arising from new bar on the rooftop will affect our sleep and therefore our health. We are also concerned that the impacted harbour view will substantially reduce the value of our property.

For the above reasons we object to the proposed development of Four Points Sheraton and urge that the proposal be rejected.

If they need a new bar they should use the new tower, surely there will be enough space...

Four Points continues to build out the views of everyone around them.

The view from my property has already been impacted by the construction of the massive tower and the proposed roof top bar will block out what view to the south remains.

Probably little point in making this submission, as it seems modification requests by Four Points go ahead regardless of what anyone in the vicinity thinks.
